17 years in federal prison. Ouch!

It looks like the trial is on. I'm not sure how many of you heard, but sometime last year, a couple of game store owners modified Xboxes and added emulators and roms for old school games. The problem? It's already illegal as it is to put those games onto an Xbox since much of it isn't freeware. On top of that, they installed the software on there with the intent to sell the units, which pretty much makes the whole copyright infringement thing a whole lot worse.

Do I think these guys deserve 17 years in a federal prison? I really don't. I know what they did was incredibly stupid and certainly not right, but 17 years seems a bit harsh, especially when rapists and murderers have gotten out in less time than that on a few occasions.

I guess we'll just have to wait and see if they are convicted of the crime. I honestly think a few years of house arrest without an internet connection in the home would be sufficient enough punishment.

But hey... I'm not in charge.

Sad thing is, people talk about modding so openly, but i bet if you were a murderer you wouldnt, lol. That's horrible... truly... 17 yrs. Should be a fine or something, confiscate their stuff... i dunno, but that many years is nuts.

Talk about fucked up priorities. Seventeen years in prison for modding a video game playing machine. How's about instead of wasting money on this trial, and to have tax payers keep them fed for seventeen years in prison we give them a year in jail, a fine, some community service, and then go after real fucking criminals?

Okay, if these guys get put away for 17 years I think I'll try to find a way to leave this planet.

In todays society the authorities are far too harsh on crimes involving the theft of money. Whilst undeniably theft is wrong and should be punished, as a crime it will never, ever compare to rape or murder in terms of morality.

Admittedly, I think the mention of 17 years here is more to scare people. They'll probably get 3-4 years which i think is too much. Mainly because prison isn't a very good punishment for theft.

Big fines and community service working off those fines would be far more suitable.

OH that'd be a horrible way to go... Simpsons has degraded so far.... I think it had its run and step aside... or go to jail... make criminals watch re-runs of the simpsons or something...

I like The Simpsons, but it's been a few years since I've gone out of my way to watch it.

I'm headed that way with South Park, but not because I think it's getting stale. There's plenty of topical humor in the show. It's more that I don't go out of my way to watch much anyhow.

Well technically they can't really get nailed for the emulator, unless the creator of said emulator wants to jump on them as well (which I doubt they are stupid enough to do), because emulator software itself is not illegal. As for the ROMs...

There is a good deal of misinformation on the Internet regarding the backup/archival copy exception. It is not a "second copy" rule and is often mistakenly cited for the proposition that if you have one lawful copy of a copyrighted work, you are entitled to have a second copy of the copyrighted work even if that second copy is an infringing copy. The backup/archival copy exception is a very narrow limitation relating to a copy being made by the rightful owner of an authentic game to ensure he or she has one in the event of damage or destruction of the authentic.

Either way, 17 years is ridiculous. A slap on the wrist amount of community service and a hefty fine (hefty for a NORMAL person, not a corporation!) would be best. I'm all for stopping the theft of intellectual property since it's been done to me countless times in the past, but that's just an insanely overreactive response to what they "allegedly" did.
